I {name}, the undersigned, wish to use the facilities and participate in activities provided by MAD5 Fitness LLC DBA The Maddison Fitness Facility. By signing this waiver, I acknowledge and agree to the following terms:

Assumption of Risk:

I acknowledge that using gym facilities, equipment, group classes, personal training, and participating in physical exercise involves inherent risks, including but not limited to physical injury, strain, discomfort, and the possibility of serious injury or death. I assume all risks and responsibility for any injuries or other medical incidents known and unknown.

Waiver and Release:

I hereby release, waive, discharge, and agree not to sue MAD5 Fitness LLC DBA The Maddison Fitness Facility, its employees, representatives, affiliates, independent contractors, or agents from any claims, demands, liabilities, rights, damages, expenses, and causes of action of any nature arising from my use of the gym facilities, the gym classes and events whether caused by the negligence of MAD5 Fitness LLC DBA The Maddison Fitness Facility, its employees, representatives, affiliates, independent contractors, or agents or otherwise.

Indemnity Agreement: I {name}, the undersigned, acknowledge and understand that participating in physical activities, fitness training, and other services provided by MAD5 Fitness LLC DBA The Maddison Fitness Facility comes with inherent risks, including but not limited to, physical injury, illness, or in extreme cases, death.

Medical Representation:

I represent that I am physically fit to use the gym facilities, classes, personal training, events, and participate in physical exercise. I have no medical condition that would prevent my safe participation. If I have any medical

conditions or concerns, I have consulted with a healthcare provider and obtained clearance to participate.

Rules and Regulations:

I agree to abide by all rules, regulations, and policies of MAD5 Fitness LLC DBA The Maddison Fitness Facility, including proper use of equipment, following safety guidelines, and respecting other members and staff.

Consent to Medical Treatment:

I hereby consent to receive any necessary medical treatment resulting from my use of the gym facilities classes, personal training and agree to bear all costs associated with such treatment.

Terms and Conditions:

1. Risk Acknowledgment: I acknowledge that I am participating in activities that may pose risks to my health and safety. 2. Liability Waiver: I hereby release, indemnify, and hold harmless MAD5 Fitness LLC DBA The Maddison Fitness Facility, its employees, representatives, affiliates, independent contractors, or agents from any and all claims, demands, or causes of action arising from my participation. 3. Health Declaration: I declare that I am physically fit and have no medical condition that would prevent my full participation in any gym related activities. 4. Equipment & Facilities: I agree to use the gym equipment and facilities with care and to immediately report any damage or breakage. 5. Updates: I understand that MAD5 Fitness LLC DBA The Maddison Fitness Facility may change the terms of this indemnity form at any time and agree to abide by any updated terms

Photo/Video Release: 

Participant hereby grants MAD5 Fitness LLC DBA The Maddison Fitness Facility (TMF) permission to use my photograph/video image in any and all publications for MAD5 Fitness LLC DBA The Maddison Fitness Facility (TMF), including web site entries, without payment or any other consideration in perpetuity. Participant hereby authorizes MAD5 Fitness LLC DBA The Maddison Fitness Facility (TMF) to edit, alter, copy, exhibit, publish or distribute all photos and images. I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my photo appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph or video images.

With your consent, MAD5 Fitness LLC DBA The Maddison Fitness Facility would like to send text (SMS) messages to the mobile number and emails to the email you have provided in our records. By providing your informed consent where indicated, you acknowledge that you have understood the information below and agree to participate in our text (SMS) messaging and email services. Purpose and Description: MAD5 Fitness LLC DBA The Maddison Fitness Facility text (SMS) messaging and email service is designed to provide you with helpful information, reminders, and notifications via text messages sent to your mobile phone and email. We may use text (SMS) messages and emails to communicate with you for a variety of purposes, including:

• reminders about membership renewal

• Schedule and business hour changes

Voluntary Participation: Participation in our text (SMS) messaging service is entirely voluntary. You have the right to refuse or withdraw your consent at any time. MAD5 Fitness LLC DBA The Maddison Fitness Facility (TMF) does NOT offer childcare. If you choose to bring your child in with you are responsible for your child/children. Children are not allowed by the treadmills or machines, and equipment. Children must remain in the Nutrition Shop area. If any equipment is damaged by your child/children, the parent/legal guardian will be held liable for any damages and/or fees. I willingly assume full responsibility for the risks that I am exposing myself, my child, children, legal guardianship of an individual(s) and accept full responsibility for any injury or death that may result from knowingly, and willingly working out/training on my own and/or participation in any activity or class while training with MAD5 Fitness LLC DBA The Maddison Fitness Facility (TMF), on or off premises.

I am competent to contract in my own name. I have read this Waiver and Release of Liability, and I fully understand the contents, meaning, and impact of this release. I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving substantial legal rights. I have read this Gym Waiver and Release Agreement, understood its contents, and agree to be bound by its terms.
